Terms and Conditions for MOWO AFRICA

Welcome to Mowo, a community-based affiliate e-commerce platform.
By downloading, accessing, or using the Mowo app or website, you agree to these Terms and Conditions (“Terms”).
Please read them carefully. If you do not agree, you must stop using Mowo immediately.

1. Definition

“Mowo,” “we,” “our,” “us” – refers to the Mowo platform and its operators.
“User,” “you,” “your” – refers to anyone using Mowo (buyer, seller, or referrer).
“Platform” – refers to the Mowo app, website, and services.
“Community” – refers to the network of users, stores, and affiliates on Mowo.

2. Eligibility

You must be at least 18 years old to use Mowo. By using the platform, you confirm that all information you provide is true, accurate, and up to date.

3. User Accounts

You are responsible for keeping your account login details safe. You must not share your account or impersonate another person. Mowo may suspend or terminate accounts found violating these Terms.

4. Use of the Platform

Mowo is a community affiliate platform where users can:
Buy from partner stores.
Earn cashback on purchases.
Earn referral commissions for inviting others.
Connect with the community (likes, follows, messages).
Users agree to use the platform only for lawful purposes.
Any fraudulent activity (fake purchases, fake referrals, misuse of community features) will result in account suspension, fines, or legal action.

5. Payment and Rewards

Purchases must be made through the Mowo app or verified payment channels to qualify for cashback or commissions.
Cashback and referral rewards are subject to processing times, verification, and withdrawal rules set by Mowo.
Mowo reserves the right to adjust, delay, or refuse payment if fraud or misuse is suspected.

6. Sellers and Stores

6.1. Anti-Fraud and Conspiracy Clause Any seller found conspiring with a buyer to manipulate transactions, claim unearned cashback/commissions, or engage in fraudulent activity shall be liable to pay a fine of up to ₦1,000,000 (One Million Naira), or five (5) times the value of the fraudulent transaction (whichever is higher).

6.2 Whistleblower Reward
If a buyer or user reports verifiable evidence of conspiracy, fraud, or manipulation between sellers and buyers, and such report is confirmed after Mowo’s investigation, the whistleblower shall receive 80% of the fine recovered from the offending seller(s).
Mowo reserves the right to determine what constitutes sufficient evidence and how the fine will be enforced.
False or malicious reporting will result in penalties, suspension, or account termination.

7. Community Guidelines

Please be sure to respect other users. Harassment, spam, hate speech, or abusive behavior is strictly prohibited.
Users may report misconduct, and Mowo reserves the right to ban or suspend offenders.

8. Intellectual Property

All logos, trademarks, and platform content belong to Mowo unless otherwise stated.
Users may not copy, modify, or distribute Mowo’s intellectual property without permission.

9. Liability and Disclaimers

Mowo is a facilitator and does not guarantee product quality, delivery times, or store performance.
Users agree that Mowo will not be held liable for:
Losses due to store disputes.
Delays in cashback or commission payments.
Technical issues or app downtime.
Use of Mowo is at your own risk.

10. Privacy

Mowo collects and processes data in line with our Privacy Policy.
By using the app, you consent to Mowo storing and using your data for operations, community engagement, and security purposes.

11. Modifications

Mowo may update these Terms at any time. Users will be notified, and continued use means acceptance of the changes.

12. Termination

Mowo reserves the right to suspend or terminate your account at any time if you:
Violate these Terms.
Engage in fraud or misuse.
Harm the Mowo community or reputation.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.
Any disputes shall be handled by the courts of competent jurisdiction in Nigeria.

14. Seller Terms & Conditions (Commission & Fees)

14.1 Commission and Fees

14.1.1 Mowo Africa charges a total commission of Six Percent (6%) on every successful transaction made through the Mowo platform.

14.1.2 The commission is automatically deducted from the sale amount before the Seller's payout is processed.

14.1.3 The commission is applied on the final selling price of the product as displayed to the buyer at checkout.

14.1.4 This fee covers platform usage, buyer rewards, technology, support, and all services provided by Mowo Africa.

14.2 Payouts to Sellers

14.2.1 Seller earnings = Total Sales Amount – 6% Commission.

14.2.2 Payouts are made to the Seller's registered bank account according to the payout schedule provided on the Mowo Seller Dashboard.

14.2.3 Mowo Africa may delay payouts for transactions flagged for verification, fraud review, or unresolved disputes.

14.3 Price Accuracy & Calculation

14.3.1 Sellers are responsible for ensuring that product prices listed on Mowo Africa are accurate and updated.

14.3.2 Any price errors that affect commission or payout calculations are the Seller's responsibility.

14.4 Changes to Commission

14.4.1 Mowo Africa reserves the right to review or adjust the commission rate at any time.

14.4.2 Sellers will receive notice of changes before the revised rates become effective.

14.4.3 Continued use of the platform after an update constitutes acceptance of the revised terms.

14.5 Taxes

14.5.1 Sellers are fully responsible for reporting and paying their own taxes in accordance with Nigerian laws (including VAT and income tax).

14.5.2 Mowo Africa does not assume liability for any tax obligations of the Seller.

14.6 Acceptance of Terms

By registering as a Seller on Mowo Africa, you agree to:
• The 6% commission,
• All conditions outlined in this document, and
• The automatic deduction of commission from sales.
